terms & Conditions for Membership holders
These terms are legally binding.
In these terms and conditions (Terms), we, us and our means Federation of Canada India Commerce & Industry [FCICI] and you mean the person who uses our membership to access the Services under the selected membership program [and any other program in future] for now and these Terms govern your access and use of the Services.
Read and check the box to agree. You must read and agree to these terms, which are a legally binding contract between you and us, before you can use and access the services.
By checking the box on-screen, you confirm (i) that you are the age of majority in the place where you live and (ii) that you have read and agree to these terms. These terms take effect on the date that you check the box. You cannot access the membership & its services unless you have read and agreed to these terms.
Keep a copy of the Terms. You can print or save these terms using the print or save function in your browser. You may also save a copy of this application for your future reference.
No changes to agreements. Unless expressly provided otherwise herein, these Terms do not replace any other agreement you may have with us or any associate of FCICI (now or in the future), including any consent or preference regarding the collection, use and disclosure of your personal information. All of the terms of your other agreements with us or any other FCICI & its associates continue to apply.
Please see the definitions section at the end of these terms for any other capitalized words not otherwise defined.
What is the Service:
Under these Terms, the Services means features, functionality, content and information provided by us via the Website and include any services that may be provided by Service Providers and Third Parties.
- General terms
A Membership will expire annually. A renewal of membership can be done one month prior to expiration, provided that the membership holder is still a Member and pays for the respective fee.
Once a membership holder is no longer a member of the program they are no longer entitled to use the FCICI Membership.
FCICI reserves the right to vary these terms and conditions from time to time without notice to Members. Current terms and conditions will be published on the Website.
FCICI gives no warranty as to the continuing availability of the Program. Any and all offers, discounts and other benefits associated with the Program may be varied or withdrawn by FCICI at any time without any prior written notice to Members.
Any misuse of the membership or this Program in contradiction with the current terms and conditions may result in the immediate cancellation or suspension of the membership and any discounts or benefits attaching to the membership, subject to any rights that cannot be excluded by applicable law.
To the extent permitted by law, FCICI and any of their officers, team members or agents are not liable for any loss or claim of any kind (including, without limitation, consequential or economic loss or loss of profits), arising under or in connection with these terms and conditions or the Program, including, without limitation, any changes to these terms and conditions.
It is a condition of these terms that a Member consents and authorises FCICI to collect, use and disclose personal information of the Member for the purposes of that Member’s participation in this Program.
The use of your Membership may not be available in conjunction with any other offers participating Retailers might be running.
Your Membership is strictly non-transferable and so cannot be used by either friends or family members or other third parties. Other Members or representatives of FCICI may ask you to show photo identification such as a driving licence or passport to confirm that you are the Member or are permitted by law to make any acquisition. Any attempted misuse of the Membership will result in cancellation of the membership.
- Third party content
FCICI is not responsible for the content of any site linked to or from the Site. Your linking to any other site is entirely at your own risk. While FCICI may provide links on this Site to other sites, the inclusion of such links is for your convenience and information only and should not be interpreted as an endorsement of the owner/sponsor of the site or the content of the site. To the extent permitted by law, FCICI disclaims all warranties, express and implied, as to the accuracy, validity, legality or otherwise of any materials or information contained on such sites.
FCICI is also not responsible for the content (including representations) of any third-party advertisement on the Site. The inclusion of any third-party advertisements on the Site should not be interpreted as an endorsement or recommendation by FCICI of the third-party advertiser or the content of the third-party advertisement. To the extent permitted by law, FCICI disclaims all warranties, express and implied, as to the accuracy, validity, legality or otherwise of any third-party advertisements on the Site.
Features and information of third-party suppliers, third party products and/or services described or depicted on the Site, or available for enquiry or application through Site hyperlinks, including, without limitation, availability and descriptions of products or services as displayed on the Site and via Site hyperlinks are subject to change at any time without notice.
- Social media platforms
The Site contains social media links, applications or features (including but not limited to Facebook and Twitter) and the use of any social media platforms are subject to the particular social media platform’s prevailing terms and conditions of use. By using any social media applications or features on the Site, you consent and agree to be bound to the particular terms and conditions of use of the social media platform.
You also acknowledge and consent to this Site accessing information you may have shared with the particular social media platform and contacting you via the social media platform or via the information you have shared (for example, sending an email directly to you to the email address provided to the social media platform), in accordance with the permissions you have granted this website via the social media platform.
Users are encouraged to review the terms and conditions of use of each social media platform before engaging or interacting with the social media links, applications or features on the Site.
You will ensure that all information you provide during registration, including your name and postal information is accurate and complete. An email will be sent to you, so that you may verify your registration. You will verify your registration in a timely manner.
FCICI is not liable for any products or services provided by or through any Benefit Partner or other member/s, or for any error, omission or inaccuracy in advertising material or for any liability resulting directly or indirectly from a product or service provided by any Benefit Partner or other third party in connection with the membership programme.
FCICI reserves the right to terminate your Membership at any time if we determine that you have violated any of these Terms.
- Liability
FCICI will not be responsible for any indirect losses, consequential, exemplary, special or punitive damages, lost opportunities, loss of profits, anticipated profits, actual or anticipated savings.
FCICI does not limit its liability at law for fraudulent misrepresentation or for death or personal injury caused by negligence or any other type of liability which cannot by law be excluded or limited.
FCICI will not be under any obligation to become involved in any dispute between you and any Service/product offeror. Any complaints should be taken up with the participating Establishment/Individual/professional/member.
FCICI does not give any warranty for any goods or services offered by associates.
- Waiver
Failure by FCICI to enforce any of these terms and conditions will not prevent FCICI from subsequently relying on or enforcing them.
- Severability
If any court or competent authority decides that any of the provisions of these terms and conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.
- Proprietary Rights
FCICI owns or has the right to use all proprietary rights in the membership and its related activities and services. The membership and its related activities and services contains the copyrighted material, trademarks, and other proprietary information of FCICI and its licensors.
In addition, other Members may post copyrighted information, which has copyright protection, whether or not it is identified as copyrighted. Except for that information for which you have been given verifiable permission to use, you will not copy, modify, display, publish, perform, transmit, distribute or sell any such proprietary information.
By posting information or content on any public area of the website, you automatically grant, and you represent and warrant, that you have the right to grant: the Service and its designees a perpetual, worldwide, royalty-free, license to use, reproduce, modify, translate, transmit, and distribute any information or material that you supply or communicate to the Service, in any such medium now in existence or hereafter developed, for any purpose, including commercial uses.
Events, competitions, promotions and other offers
From time to time, FCICI (or selected third parties) may include events, competitions, promotions or other offers on this Site. Each such offer shall be subject to its own express terms and may not be available in all jurisdictions.
- No Right to Vote in Annual General Meetings:
The member has understood that he/she or any identity through its representative, does not have any right to vote in any annual general meetings of the Federation of Canada India Commerce & Industry. The applicant understand that these Membership Program are only run to facilitate and help members to network, get help from other members for their professional & business needs. The membership offered here does not make any member eligible to be part of any administrative committee or any other similar appointed working committee by board of trust..
- Entire Agreement
9.1. These terms and conditions constitute the whole agreement between us and supersede all previous discussion, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these terms and conditions.
9.2. Each of the parties agrees that it has not entered into these terms and conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these terms and conditions or not) other than as expressly set out in these terms and conditions.
- Law and Jurisdiction
This agreement shall be interpreted in accordance with Canada law and will be subject to the non-exclusive jurisdiction of the Ontario – Canada Courts.
